Magistrates class 7...oct 18th

 2010-10-18 22:22:11 note card

Meeting Summary: Magistrates Course - Week 7 (Review and Case Study)

Instructor: Janette Inglewood

Participants:

  • Nitya Burckhardt

  • Quiet Clarity

  • VolmarrGoth Vollmar

  • Poindexter Hamelin

  • Gilbert Froobert

  • Bernhard Madsen

  • Loki Greymoon

  • Jakis Babcock

Janette Inglewood led the seventh week of the Magistrates course, focusing on a summary of key topics covered throughout the previous weeks and a case study analysis. The class served as a review before the final quiz in Week 8.

Key Topics Reviewed:

  • Jurisdiction: Emphasized as the main topic. Participants reviewed which type of law applies to different scenarios:

    • Denying the existence of Priest Kings: Initiate Law

    • Facestripping a Free Woman in her City: City Law

    • Warrior kicking a Scribe: City and Caste Law (though Janette noted it was a "weak example")

    • Stealing from a wagon on the highway: Merchant Law

    • The instructor stressed the importance of not ruling outside one's jurisdiction.

  • Sentencing

  • OOC/IC (Out-of-Character/In-Character)

  • Investigating

  • Trials

  • The Laws

Case Study Analysis: Intrusion into a Banner Keep

The class analyzed a case study involving a woman found in tunnels beneath a banner keep.

  • Applicable Law: Since the incident occurred in a banner keep, the City Law of the associated city applies, as a banner keep is considered an extension of the city. Merchant Law would also apply for financial/trade-related issues.

  • Potential Witnesses:

    • City guards

    • Builders

    • City inspectors

    • Her escorts (if any)

    • The Free Woman (the accused)

    • The Free Slaver (the accuser)

  • Potential Evidence:

    • Physical evidence at the tunnel entrance (e.g., signs of accidental fall vs. purposeful entry)

    • Structural weaknesses in shafts

    • Tools (for breaking in)

    • Condition of her robes (tears, dirt)

    • Her injuries (to be checked by a Green Caste member)

    • Evidence of spying if applicable (maps, inventory lists, tally of money, lists of entry points, notes on guard strength).

  • Potential Crimes & Penalties:

    • The primary concern was spying or map-making.

    • The sentence for map-making is death (impalement).

  • Investigation Process: The instructor emphasized the importance of a thorough investigation, including searching the accused, the area, her room, and anyone she contacted. Magistrates rely on caste professionals (e.g., builders, physicians) for reports and must ensure these investigations are comprehensive.

  • Court Proceedings:

    • Ideally, advocates would present the case, but Magistrates must be prepared to ask questions themselves as they control their court.

    • The instructor shared an anecdote about maintaining control in court by addressing disruptive individuals through their Ubar.

    • Magistrates must be firm but calm, avoid debating the law, and expect respect. Emotes are treated as spoken words.

  • Magistrate's Core Codes: The Blue Caste core codes were reiterated: objectivity, integrity, and duty.

Case Study Outcome (from previous week's class, as revealed by Janette):

In the actual trial (from a previous class session), the Lady in the case study was found not guilty because no incriminating evidence (such as maps or tools) was found, demonstrating that the outcome depends entirely on the evidence presented.

The class concluded with Janette expressing gratitude for the participants' engagement and contribution.

[13:05] janette Inglewood: one class after this

[13:05] Nitya Burckhardt cheers quietly

[13:07] janette Inglewood: investigating.......trials...and the laws

[13:08] janette Inglewood: we have looked at each of these areas

[13:08] janette Inglewood: in as much detail as we can

[13:09] janette Inglewood: in our allowed time

[13:09] janette Inglewood: i hope the picture has become clearer for You over the weeks

[13:10] janette Inglewood: jurisdiction is really the main one

[13:10] janette Inglewood: remember.....Initiates.......City.......merchant .....Caste

[13:11] VolmarrGoth Vollmar pushes flower to the side so she is not sitting on top of him

[13:11] janette Inglewood: so......of those 4..........

[13:11] janette Inglewood: somebody denies existence of PK's...which laws?

[13:12] VolmarrGoth Vollmar: Initiate law

[13:12] janette Inglewood: yes

[13:12] janette Inglewood: somebody facestrips a FW in Her City?

[13:13] Poindexter Hamelin: civil

[13:13] VolmarrGoth Vollmar: city

[13:13] janette Inglewood: yes

[13:14] janette Inglewood: a Warrior kicks a Scribe up the behind for being in the way?

[13:15] VolmarrGoth Vollmar: city and caste

[13:15] janette Inglewood laughs.......weak example.......yes

[13:15] Gilbert Froobert: buy the warrior a horn of mead

[13:15] janette Inglewood: somebody steals from a wagon on the highway?

[13:15] VolmarrGoth Vollmar: merchant

[13:15] Poindexter Hamelin: merchant

[13:16] janette Inglewood: correct

[13:16] janette Inglewood: everyone clear?

[13:16] Nitya Burckhardt nods

[13:16] janette Inglewood: do not rule when it is not Your jurisdiction

[13:18] janette Inglewood: now then please help pass these around

[13:20] VolmarrGoth Vollmar: "this is from the other class"

[13:20] janette Inglewood: yes

[13:20] janette Inglewood: Advocates have seen it

[13:21] janette Inglewood: all have case study 3?

[13:21] Poindexter Hamelin doesn't.

[13:22] Nitya Burckhardt: I do not believe I do either

[13:22] janette Inglewood: please pass them

[13:23] janette Inglewood: lag is killing

[13:23] janette Inglewood: i removed my meter

[13:23] janette Inglewood: helps a bit

[13:23] janette Inglewood: ok all got them?

[13:23] Poindexter Hamelin still doesn't.

[13:24] Bernhard Madsen nods

[13:25] Poindexter Hamelin: Now I have three copies. Thank you

[13:25] janette Inglewood: now then

[13:25] janette Inglewood: have a read......and consider the main issues

[13:26] janette Inglewood: firstly.......it is in a banner keep

[13:26] janette Inglewood: so...what law will apply?

[13:27] VolmarrGoth Vollmar: merchant amd that of it's home city

[13:27] janette Inglewood: yes

[13:28] janette Inglewood: the banner keep is in effect, part of the City

[13:28] janette Inglewood: merchant law would apply to coins......sales......and so on

[13:29] janette Inglewood: and city law to this example

[13:29] janette Inglewood: so...when we say a City's laws end at its walls........

[13:30] Poindexter Hamelin: A banner keep is considered within the walls.

[13:30] janette Inglewood: here is an example when it goes beyond them

[13:30] janette Inglewood: yes exactly

[13:31] janette Inglewood: now Volmarr was mag for his in the advocates class

[13:31] janette Inglewood: *this

[13:32] janette Inglewood: what witnesses might be called?

[13:32] Gilbert Froobert: city guards

[13:32] janette Inglewood: yes

[13:32] VolmarrGoth Vollmar: Builders, City Inspectors..

[13:32] janette Inglewood: yes

[13:33] janette Inglewood: who else?

[13:33] Poindexter Hamelin: Would you wish to call on scribes to speak of Northern customs?

[13:33] VolmarrGoth Vollmar: Her Escorts if she had any

[13:33] janette Inglewood: well.....unlikely but i see Your point

[13:34] janette Inglewood: yes Her escort

[13:34] Poindexter Hamelin: For example, a trained scribe should be able to identify regional accent and help ascertain if she was truly from the North

[13:34] Gilbert Froobert: her jarl

[13:34] janette Inglewood: and of course Her

[13:35] janette Inglewood: and the FS

[13:36] janette Inglewood: this case can vary greatly depending on testimony

[13:36] janette Inglewood: what evidence might we look for?

[13:37] Poindexter Hamelin: Check the entrance of the tunnels for evidence of an accidental fall rather than purposeful entry

[13:37] VolmarrGoth Vollmar: if there are structural weaknesses in the shafts

[13:37] janette Inglewood: yes...good

[13:37] Bernhard Madsen: check if arsenal and treasury has been moved

[13:37] Loki Greymoon: if the woman did fall she would more then like;ly be injured

[13:37] Bernhard Madsen: part of it I mean

[13:37] janette Inglewood: what crime might She be committing?

[13:38] Gilbert Froobert: Check the opening for dirt to help explain where her robes were so dirty

[13:38] Poindexter Hamelin: Check her robes for tears also.

[13:38] Loki Greymoon: could be a spy

[13:38] VolmarrGoth Vollmar: "spying, trying to steal"

[13:38] Bernhard Madsen: assessing the supply of arms of the city

[13:38] janette Inglewood: if She was a spy...what evidence might one find?

[13:39] Gilbert Froobert: maps

[13:39] Gilbert Froobert: inventory list

[13:39] Jakis Babcock: City maps

[13:39] janette Inglewood: yes!!

[13:39] Gilbert Froobert: tally of money found

[13:39] Loki Greymoon: list of enrty points

[13:39] janette Inglewood: my first feeling is...map making

[13:39] Poindexter Hamelin: notes on guard strength

[13:39] VolmarrGoth Vollmar: "is there is evidence also she was trying to take maps outside the city, impailment just for that"

[13:39] janette Inglewood: what is the sentence for map making?

[13:40] janette Inglewood: yes........death

[13:40] VolmarrGoth Vollmar: "if bringing maps outside the city of the city, impailment "

[13:40] janette Inglewood: excellent

[13:40] janette Inglewood: so...She may be on trial for Her life

[13:40] VolmarrGoth Vollmar: "indeed"

[13:40] Loki Greymoon: chop off her head

[13:41] janette Inglewood: now....if any were found.......things would be simple

[13:42] Loki Greymoon: Lady Jan

[13:42] janette Inglewood: so ......She needs to be searched...as does the area

[13:42] janette Inglewood: yes Loki?

[13:43] Loki Greymoon: smiles i was going to say if i was the FS i would have the entier area as well as her and her room where ever she is staying search

[13:43] janette Inglewood: yes....everywhere

[13:43] janette Inglewood: including her body

[13:44] Loki Greymoon: and if necessary anyone she may have contacted

[13:44] janette Inglewood: so....lets say nothing is found

[13:44] janette Inglewood: She is bruised....there is a hole in the tunnel

[13:45] janette Inglewood: what next?

[13:45] Gilbert Froobert: Look at the hole

[13:45] janette Inglewood: yes!

[13:45] Gilbert Froobert: see if it was broken into

[13:46] Gilbert Froobert: or deliberate

[13:46] janette Inglewood: as we did in the trial...get a builder's report on the hole

[13:46] Loki Greymoon: in the search you should have looked for tools

[13:46] janette Inglewood: yes Loki

[13:46] Gilbert Froobert: they found nothing on her

[13:47] Poindexter Hamelin: Is anything found in her room?

[13:47] janette Inglewood: is the tunnel weak.....maybe others made the hole for Her

[13:47] janette Inglewood: no we have found nothing

[13:48] janette Inglewood: now as Magistrate..You will be relying on these Caste professionals to have done this

[13:48] Loki Greymoon: see if you can find out who sghe has been talking to they may know something

[13:49] janette Inglewood: also a Green maybe to check her injuries

[13:49] Gilbert Froobert: Look at the opening of the hole

[13:49] Gilbert Froobert: could this have caused the bruise

[13:49] Gilbert Froobert: or was it from something else

[13:50] janette Inglewood: but in reality You need to ensure the investigation is thorough

[13:51] Poindexter Hamelin: How feasible would it be to have multiple caste experts look at the evidence?

[13:51] janette Inglewood: so...in the trial....You are relying on these reports

[13:51] janette Inglewood: well...here in Olni i am lucky

[13:52] janette Inglewood: in a recent case i had help from the Physician and a Warrior

[13:52] Jakis Babcock shifts

[13:52] Loki Greymoon: wonders which case

[13:52] janette Inglewood: and normally i am well supported here

[13:53] janette Inglewood: but yes...sometimes i have to piece it together myself

[13:53] janette Inglewood: hence my stressing of investigating, before calling a trial

[13:54] janette Inglewood: it says in this case...a hearing

[13:55] janette Inglewood: when it gets to court....we hope as Magistrates.......

[13:56] janette Inglewood:  to have advocates actually present the case

[13:56] janette Inglewood: again not always possible

[13:57] janette Inglewood: whether You do or not......You can ask any questions at any time

[13:57] janette Inglewood: it is Your court

[13:58] janette Inglewood: You control it

[13:59] janette Inglewood: so...if an advocate is being slow....dull pointless....tell them

[13:59] janette Inglewood: i did a case in Tharnock this week

[13:59] janette Inglewood: one of the crowd was annoying me

[14:00] janette Inglewood: so...i told His Ubar.....control that Man of Yours

[14:00] janette Inglewood: which was done

[14:00] janette Inglewood: no need for more

[14:01] janette Inglewood: be firm...but calm

[14:01] janette Inglewood: do not get caught up in debating the Law

[14:02] janette Inglewood: You are the expert...not them

[14:03] janette Inglewood: same as if they make emoted comment

[14:03] janette Inglewood: i said.....i treat emotes as spoken

[14:03] janette Inglewood: o fcourse...being female i have to be careful

[14:04] janette Inglewood: but all of us should remain respectful in court

[14:04] janette Inglewood: and expect respect in return

[14:05] janette Inglewood: now then......finally......we found the Lady not guilty last week

[14:06] janette Inglewood: since we found none of the things we just discussed

[14:07] janette Inglewood: however....we may have......so proving..You just do not know until You hear the evidence

[14:07] janette Inglewood: remember the Blue Caste core codes.......

[14:08] janette Inglewood: objectivity....integrity...and duty

[14:08] janette Inglewood: any questions?

[14:09] janette Inglewood: right...

[14:09] janette Inglewood: well ill send this out in group

[14:10] janette Inglewood: thank You for listening and contributing
